  3. BY INSTALLING AND USING THIS SOFTWARE, YOU ARE AGREEING TO BE
  4. BOUND BY ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT. PLEASE
  5. READ CAREFULLY BEFORE PROCEEDING. IF YOU DO NOT AGREE TO THESE
  6. TERMS, PROMPTLY DESTROY ALL COPIES OF THE SOFTWARE IN YOUR
  7. POSSESSION.

  11. On payment of applicable license fees, the Author (Jean-Daniel Meynet)
  12. will grant to you a non-exclusive license to use TimeCard as laid
  13. forth below.

  15. SCOPE OF GRANT
  16.  
  17. You may:
  18. - use TimeCard on any single device
  19. - use TimeCard on a second device as long as only one copy is used
  20.   at a time
  21. - copy TimeCard for archival purposes, provided that any copy must
  22.   contain all of the original software's proprietary notices
  23.  
  24. You may not: 
  25.  
  26. - permit other individuals to use TimeCard except under the terms
  27.   listed above
  28. - permit concurrent use of TimeCard
  29. - modify, translate, reverse engineer, decompile, disassemble or
  30.   create derivative works based on TimeCard
  31. - copy TimeCard other than as specified above
  32. - rent, lease, or otherwise transfer rights to TimeCard
  33. - remove any proprietary notices or labels on the software
  34.  
  35. DISTRIBUTION

  37. Copies of unregistered versions of TimeCard may be distributed for
  38. evaluation purposes only in accordance with the following termsá:

  40. Distribution is permitted only for the whole unregistered software
  41. package without any modifications. All accompanying files must be
  42. included. You are specifically prohibited from charging or requesting
  43. donations for any such copies without prior written permission.

  45. WARRANTY DISCLAIMER

  47. Jean-Daniel Meynet, expressly disclaims any warranty for TimeCard.
  48. TimeCard is provided "as is" without warranty of any kind, either
  49. express or implied, including, without limitation, the implied
  50. warranties of merchantability, fitness for a particular purpose,
  51. or noninfringement.  
  52. The entire risk arising out of use or performance of TimeCard remains
  53. with you. In no event shall Jean-Daniel Meynet or any other party be
  54. liable for any damages whatsoever (including, without limitation,
  55. damages for loss of business profits, business interruption, loss of
  56. business information, or any other pecuniary loss) arising out of the
  57. use of or inability to use TimeCard even if Jean-Daniel Meynet has been 
  58. advised of the possibility of such damages. 
  59. Jean-Daniel Meynet expressly disclaims any liability for errors or
  60. omissions in the content of TimeCard.
  61. The user accepts full responsibility for any damages, consequential or
  62. otherwise resulting from using TimeCard.
